1031 Exchange: Gold and Silver Exchange-Traded Funds (ETFs)

I recently received an inquiry about whether gold and silver exchange-traded funds (ETFs) are eligible for a capital gains tax deferral. The Internal Revenue Service has not issued written confirmation that a gold or silver backed ETF is eligible for a like-kind exchange. ETFs are considered a security and securities are not 1031 eligible. Until the IRS issues a ruling such as a Private Letter Ruling, metal ETFs may be excluded from 1031 consideration.
